Without the 10K and 10Q there is a whole class of litigants, err, I mean share holders, who are prevented from selling their shares on the open market. In the unlikely event of a share holder lawsuit, those folks will need a way to figure out how much they would have made, were they able to dump, err, I mean sell their holdings sooner.

I can speculate on what would happen to the stock price if any of those large share holders were to dump their holdings, but I am clearly no expert in such things. But there is no need for speculation. The court can just look at the average price that BayStar is getting when it makes large sales. Unless there is something fraudulent going on, the price BayStar gets must represent the true value of the stock.

After SCOXe crashes and burns, and the shareholder lawsuits start, large holders can compare what they actually got per share for selling (or $0 if they never got to sell) with what BayStar got per share.

Do I understand how lawsuits work, or am I missing something?

I'm assuming that after the BK, Darl and Ralph will be the deep pocket lawsuit targets of choice. Who else will be a target? Do any of the media shills have deep pockets?
